Mr. Toomey finally got Gary Gensler to clarify why he thinks most digital assets are securities.
“The Supreme Court [talks about] a common enterprise. It’s not about the token being on a thousand computers, it’s [about that] group of developers in the middle.”
So the only crypto that is not a security in this sense is Bitcoin.
